Are Prenup Agreements Enforceable in Seattle?
Yes—but only if specific legal requirements are met. In Washington, courts apply a two-pronged test to determine a prenup’s enforceability:
1. Substantive Fairness
Does the agreement provide reasonable and fair terms for both parties? As a rule, the more an agreement deviates from Washington State law governing property and debt division and spousal maintenance – as is commonly the case – the more likely it will not be “substantively fair.” However, it may still be valid under the second prong, Procedural Fairness.
2. Procedural Fairness
Was the agreement entered into voluntarily, with full financial disclosure and legal representation?
To ensure enforceability, each spouse should have independent legal counsel, and the agreement should be signed well before the wedding day.
Note that provision for child support and custody terms are NOT enforceable in Washington.

What Does it Cost?
We require an advanced fee deposit of $2,500 to begin work on your prenuptial agreement. The total cost depends on the complexity of the legal and financial issues involved, as well as the level of negotiation required. In most cases, the final fee does not exceed the retainer. If your total cost is lower, the unused portion of the deposit will be promptly refunded.
